Welcome to casadiluce.ca, which is operated by ARTGLASS CANADA INC. o/a CASA DI LUCE. Please review these Terms & Conditions before using our website or making an online purchase. These Terms and Conditions apply to your access and use of our website, including when you make an online purchase, create your account, place an order or otherwise access or utilize our website. By doing so, you acknowledge that you have read, understood and agree to be bound by the following terms and conditions. This agreement is between you and ARTGLASS CANADA INC. o/a CASA DI LUCE concerning your use of our website, which is currently located at https://www.casadiluce.ca, and any other online materials and applications such as your online account. Your use of the Casa Di Luce website is governed by this Agreement regardless of how you access it, including through the Internet, through Wireless Access Protocol (“WAP”), or through a mobile network or otherwise.

CHANGES TO THESE TERMS & CONDITIONS

Casa Di Luce may in its discretion change these Terms & Conditions at any time, without any prior notice, by posting the changed Terms & Conditions on our Website. The changes and conditions are effective immediately upon posting. It is your responsibility to check the “Last Updated” date at the top of these Terms & Conditions and review any changes since the last version. By utilizing our website after the Terms & Conditions have been changed, you are signifying your acceptance and agreement to the changed terms. Changes to these Terms apply prospectively and do not retroactively change the terms of an order already accepted, except where required or permitted by applicable law.

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer protection laws that may apply.

ACCEPTABLE USE

You are responsible for your use of Casa Di Luce’s Website, and for any use of the Website or mobile applications made using your account.

DISCLAIMER OF WARRANTIES

You expressly understand and agree that your use of this website and all content available is at your sole risk and that this site is provided on an “as is” and “as available” basis. Casa Di Luce makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials or products included on this website.

To the fullest extent permitted by applicable law, in no event will Casa Di Luce or Artglass Canada Inc. be liable to you or any third party for any indirect, special, incidental, or punitive damages or damages for loss of profit, revenue or data arising out of or relating to our website.

Nothing in these Terms excludes or limits any warranty, condition, right or remedy that cannot lawfully be excluded under applicable consumer protection legislation.

YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account information and password. Your user name, password or other information that you provide to us in registering are for your personal use only. You are responsible for any use or misuse of your user name or password, and you must notify us directly of any confidentiality breach or unauthorized use of your online account.

TERMINATION

Casa Di Luce reserves the right to terminate or suspend your use of any or all online properties at any time and without prior notice when it is believed that you have violated or acted inconsistently with the outlined terms and conditions. This termination or suspension includes terminating online accounts, removing or editing content, or canceling online orders at their sole discretion. Upon any such termination or suspension, your right to use any of Casa Di Luce’s online services will immediately cease. If Casa Di Luce cancels an order after payment has been received, the amount paid for the cancelled order will be refunded, subject to applicable law.

PRODUCT PRICING INFORMATION & DISCOUNTS

The prices displayed on our website are quoted in Canadian Dollars. Casa Di Luce strives to keep their prices competitive and as a result, we reserve the right to change our posted prices without any prior notice.

Due to such events as fluctuating international exchange rates and price increases from suppliers and freight carriers, prices may also change without notice. Price changes apply prospectively and do not alter the price of an already accepted order, except where a genuine pricing error is identified and handled as described under ‘Errors on Website’.

Discounts cannot be combined with any other offer or promotion. We are happy to work one-on-one with interior designers and decorators and offer special discounts and incentives. Please contact us at sales@casadiluce.ca for further information.

ERRORS ON WEBSITE

We reserve the right to correct genuine errors, inaccuracies or omissions. If a material pricing or product-information error is discovered after an order has been placed, we will contact the customer before proceeding. The customer may accept the corrected information or cancel the affected order for a full refund.

INACCURACY DISCLAIMER

At times there may be information on our Website or in our catalog that contains errors that may relate to item descriptions, pricing and product availability. We reserve the right to correct genuine errors, inaccuracies or omissions. WARRANTIES

Casa Di Luce is an authorized reseller of the manufacturers on our website. Every manufacturer differs in the period of time that they warrant their products. Casa Di Luce does not carry its own warranty but relies on the manufacturer’s warranty conditions. During the manufacturer’s warranty period, Casa Di Luce will be there to assist you with any warranty issues, or connect you directly with the manufacturer to further assist you with any warranty claims. During the warranty period, most manufacturers will repair or replace your item, at their discretion when it is proven that the products or parts are defective. This warranty does not apply to any damages resulting from accident, alteration, tampering, misuse, negligence, or abuse. Warranty will not be applied to light bulbs.

COLOUR SWATCHES ON OUR WEBSITE

Please note that your monitor might not accurately display product colours. We cannot guarantee that the colour shown will entirely match the colour of the product you are ordering.

PAYMENTS

For orders placed online, we accept MasterCard, Visa, American Express and PayPal payments. For orders placed by phone, we can also accept wire transfer, Interac e-Transfer and cheque.

Cheque payments, where approved in advance, should be mailed to: Casa Di Luce, 89 Tycos Drive, Unit 102, Toronto, ON M6B 1W3, Canada.

SALES TAX

Casa Di Luce is located in Ontario, Canada and charges taxes applicable to Ontario. Orders shipped outside of Ontario are charged GST or HST depending on the order’s final destination. You are expected to comply with your province or state’s current laws regarding online purchases. Orders shipped outside of Canada are not subject to sales tax but may incur duties or border fees.

DAMAGED & DEFECTIVE PRODUCTS

We make every effort to pack items very carefully so that they arrive at your door safely. We realize that items can be damaged during the shipment process or may arrive with missing parts due to the delicate nature of some of the goods. Visible shipping damage, shortages or shipping errors should be reported within 72 hours of delivery so that we can promptly submit a shipping or manufacturer claim. Failure to report within this period may affect our ability to process a shipping-related claim, but does not limit any rights available under applicable law or an applicable manufacturer warranty. Please email us immediately at sales@casadiluce.ca and provide photos of the damaged or defective product. Refer to our Returns & Exchanges Policy for further information.

RETURNS & REFUNDS

Eligible items may be returned within 14 days of receiving an online order in accordance with our Returns & Exchanges Policy. Approved voluntary returns may be subject to applicable restocking fees and non-refundable shipping charges as disclosed in that policy. Nothing in this provision limits any rights available under applicable law. If the wrong product was shipped or your order is damaged in transit, please contact us within 72 hours of receiving your order. Refer to our Returns & Exchanges Policy for further information related to our return policy.

CANCELLATIONS & CHANGES

You may request to cancel or make changes to your order within 3 business days of placing the order. Please email sales@casadiluce.ca with your order number, name, address and requested change. Many orders ship or enter production quickly, so cancellation is not guaranteed once processing has begun. After 3 business days, orders are generally considered final and cannot be cancelled, except where cancellation rights are provided by applicable law. If an order has already shipped, it will be handled under our Returns & Exchanges Policy.

Our store hours are: Monday-Friday 10:00 AM-6:00 PM EST and Saturdays from 10:00 AM-5:00 PM EST.

USE OF PROMOTIONAL CODES

Promotional codes can only be redeemed online at www.casadiluce.ca. One promotional code per order, which may consist of one or more items. Promotional codes cannot be used in conjunction with any other special offer or promotional code. Any refunds or returns made will take into account that a discount was applied to your original order. Promotional codes may not be used on any existing orders and cannot be sold or exchanged for cash.
